TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PHABLETAPPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PhabletApps does not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the use of the Services will be accurate or reliable.
  • The quality of any products, services, information, or other material obtained through the Services will meet your expectations.
  • Any errors in the Services will be corrected.

Any material downloaded or otherwise obtained through the use of the Services is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or device or loss of data that results from the download of any such material.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PHABLETAPPS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Services.
  • Any conduct or content of any third party on the Services.
  • Any content obtained from the Services.
  • Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

8. Indemnification

You agree to indemnify, defend, and hold harmless PhabletApps, its directors, officers, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

  • Your use or misuse of the Services.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Any User Content you submit, upload, or transmit through the Services.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims.

9. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

If you wish to terminate your use of the Services, you may simply discontinue using them. Any data or content associated with your use may be deleted at our discretion following termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Bucharest, Romania, for the resolution of any disputes arising from or relating to these Terms or the Services.

If you are a consumer residing in the European Union, you may also be entitled to invoke the mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

For users residing outside the European Union, any dispute, controversy, or claim arising out of or in connection with these Terms shall be resolved through good-faith negotiation. If such negotiation fails, the dispute shall be submitted to binding arbitration in accordance with applicable rules, with the seat of arbitration in Bucharest, Romania.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

We will notify you of changes by posting the updated Terms on the Website and updating the "Effective Date" at the top of this page. Your continued use of the Services after the revised Terms become effective constitutes your acceptance of the revised Terms.
